Terms of Use

1. General Terms

These Terms of Use apply to all users of the Aurali platform, including Members (end users) and Professionals (independent service providers), and govern the use of AI-mediated features.

1.1 Operator and Scope

Aurali is a digital platform operated by Flutter Innovation GmbH, a company registered in Germany (“Operator”, “we”, “us”).

These Terms of Use (“Terms”) govern access to and use of the Aurali platform, including its web application, progressive web application (PWA), and related interfaces (collectively, the “Service”).

These Terms apply globally.

Specific provisions apply depending on whether you use Aurali as:

  • a Member (end user), or
  • a Professional (independent service provider).

By accessing or using the Service, you agree to the Terms applicable to your role.

1.2 Nature of the Platform (General)

Aurali is a technical platform designed to provide a neutral environment for self-directed reflection and, optionally, to enable contact between Members and independent Professionals.

Aurali and the Operator:

  • act solely as a platform provider and technical intermediary
  • are not professional service providers
  • do not provide advice, diagnosis, treatment, or guidance
  • do not supervise, endorse, or guarantee third-party services

The Operator does not curate, prioritise, rank, or recommend Professionals based on quality, suitability, or outcomes.

1.3 AI-Mediated Functionality and System Limitations (General)

Certain features of Aurali are generated or supported by automated systems, including artificial intelligence (“AI”).

You acknowledge and agree that:

  • AI-generated content is automated, probabilistic, and non-deterministic
  • Outputs may vary and are context-limited
  • The system has no understanding, awareness, intent, or judgment
  • AI outputs are provided solely as reflective stimuli

AI-generated content does not, to the maximum extent permitted by applicable law:

  • represent factual accuracy
  • constitute insight, analysis, advice, or evaluation
  • carry authority or correctness
  • replace human judgment or professional expertise

Descriptions of AI functionality are provided for transparency purposes only and do not imply system capability beyond what is expressly stated.

2. Terms for Members

2.1 Purpose of the Service for Members

For Members, Aurali provides a self-directed reflective environment, enabling engagement with non-directive prompts, summaries, and personal notes.

Aurali does not interpret, evaluate, judge, advise, recommend, diagnose, predict, or guide Members.

The Service has no inherent meaning or authority beyond the interpretation assigned by the Member.

Aurali functions solely as a technical tool for personal reflection and does not intervene in, influence, or evaluate user content or decisions.

2.2 No Medical, Therapeutic, or Professional Services

Aurali is not:a medical device

  • a healthcare service
  • a therapeutic, psychological, or counseling service
  • a coaching or advisory service

Aurali does not provide:

  • medical advice
  • mental-health diagnosis
  • psychological treatment
  • crisis intervention
  • emergency support

The Service is not designed for use in situations of emotional crisis, acute psychological distress, or risk of harm.

Members requiring such assistance must contact qualified professionals or emergency services.

2.3 Member Responsibility and Interpretation

Members remain solely and exclusively responsible, to the maximum extent permitted by applicable law, for:

  • how they interpret any content encountered through the Service
  • any conclusions they draw
  • any actions they take or refrain from taking

Aurali does not influence, direct, or determine Member decisions or outcomes.

Use of the Service does not create reliance, expectation of benefit, or entitlement to results.

2.4 Eligibility

The Service is intended for individuals 18 years of age or older.

By using Aurali as a Member, you confirm that you meet this requirement.

3. Terms for Professionals

3.1 Independent Contractor Status

Professionals act exclusively in their own name and on their own responsibility.

Nothing in these Terms creates or implies:

  • employment
  • partnership
  • joint venture
  • agency
  • representation or mandate

Professionals are independent third-party service providers, not employees or agents of the Operator.

3.2 No Endorsement, Verification, or Supervision

The Operator does not, to the maximum extent permitted by applicable law:

  • endorse Professionals
  • verify qualifications beyond basic administrative checks, if any
  • supervise or evaluate professional services
  • guarantee quality, legality, suitability, or outcomes

Any professional relationship formed exists solely between the Professional and the Member.

3.3 Sole Responsibility of Professionals

Professionals are solely responsible for:

  • their qualifications, certifications, and licenses
  • compliance with applicable laws and regulations
  • the content, nature, and delivery of their services
  • advice, guidance, or statements provided
  • all outcomes and consequences of their services

Professionals are solely responsible for determining whether their services may legally be offered in the jurisdictions in which Members are located.

The Operator bears no responsibility for professional conduct or results, to the maximum extent permitted by applicable law.

3.4 Indemnification by Professionals

Professionals agree to fully indemnify and hold harmless the Operator from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from or related to:

  • professional services provided
  • breach of these Terms
  • violation of applicable laws or regulations
  • claims by Members or third parties

4. Common Terms

4.1 Accounts and Use

Some features may be used without registration. Other features require account creation.

Users are responsible for:

  • maintaining confidentiality of access credentials
  • all activity under their account

The Operator may restrict or terminate access in cases of misuse or violation of these Terms.

4.2 Data and Privacy

Personal data is processed in accordance with the Privacy Policy, which forms an integral part of these Terms.

Aurali follows a data-minimisation and user-control model:

  • reflections are processed ephemerally by default
  • data is stored only when explicitly saved by the user
  • users may delete their content at any time

User data is not used to train general or proprietary AI models.

For users located in Brazil, personal data is processed in accordance with the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados – LGPD), in addition to applicable European data-protection standards.

4.3 Intellectual Property

All software, design elements, trademarks, and system components are the intellectual property of Flutter Innovation GmbH or its licensors.

A limited, non-exclusive, non-transferable right to use the Service is granted solely for its intended purpose.

4.4 Prohibited Use and Misuse Exclusion

The Service must not be used:

  • as a substitute for professional, medical, or therapeutic care
  • in emergencies or situations involving harm
  • to obtain advice, diagnosis, or treatment
  • in violation of these Terms or applicable law

The Operator disclaims responsibility for use outside the intended scope, to the maximum extent permitted by applicable law.

4.5 Availability and Changes

The Service is provided on an “as is” and “as available” basis.

The Operator may modify, suspend, or discontinue features at any time without guarantee of availability.

4.6 Limitation of Liability

To the maximum extent permitted by applicable law:

  • the Operator is not liable for indirect, incidental, or consequential damages
  • the Operator is not liable for decisions or outcomes based on user interpretation
  • the Operator is not liable for AI-generated content
  • the Operator is not liable for third-party professional services

Statutory liability that cannot be excluded remains unaffected.

4.7 Governing Law and Mandatory Local Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules.

Where mandatory consumer-protection or data-protection laws in a user’s country of residence apply, such laws shall prevail to the extent required, without affecting the remaining provisions of these Terms.
